These Terms of Service (“Terms”) are an agreement between you and Delta Tech Studios, operated by Trevor Mooney in New York, United States (“Delta Tech Studios,” “we,” “us,” or “our”). They govern your access to Tap N Jump, its Discord Activity, player account features, websites, and related services (together, the “Service”). By accessing the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and platform rules
You must be legally able to agree to these Terms. To use Tap N Jump through Discord, you must be at least 13 years old and meet Discord’s minimum age requirement for your country. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf. You must also follow the rules and terms of every platform through which you use the Service, including Discord’s Terms of Service when using the Discord Activity.
2. Limited license
Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to access and use the Service for lawful, non-commercial entertainment. The Service, including its code, art, audio, designs, characters, names, and other content, is owned by us or our licensors and is protected by intellectual-property law.
3. Player accounts and linked identities
You are responsible for activity under your player account and for maintaining the security of any connected platform account. Provide accurate information, protect your credentials, and notify us promptly if you suspect unauthorized access. We may allow you to link platform identities. Linking or unlinking can affect access to progress, inventory, entitlements, or account recovery. Do not attempt to access another person’s account.
4. Acceptable use
You may not:
- Cheat, automate play, exploit bugs, manipulate scores, or interfere with matchmaking, lobbies, leaderboards, or other players.
- Reverse engineer, bypass security, probe infrastructure, distribute malware, overload the Service, or access non-public systems except where applicable law expressly permits it.
- Harass, threaten, impersonate, defraud, or share unlawful or infringing material through the Service.
- Sell, transfer, rent, or commercially exploit an account, virtual item, entitlement, or access to the Service without our written permission.
- Use the Service in a way that violates law, these Terms, or an applicable platform’s rules.
5. Virtual items, currency, and purchases
The Service may include virtual currency, cosmetics, or other digital items. These are licensed access rights, not cash, property, or a bank account. They have no monetary value outside the Service, cannot be redeemed for cash, and may be changed or discontinued as the Service evolves. Purchases are processed by the applicable storefront or platform and are subject to its payment, cancellation, and refund rules. Except where law or a platform requires otherwise, completed digital-item purchases are final.
6. Testing features and service changes
Testing, preview, or beta features may be incomplete, unstable, or changed without notice. We may update, balance, suspend, restrict, or discontinue any part of the Service. We do not promise that progress, scores, availability, or features will remain unchanged forever, though we aim to communicate material changes reasonably.
7. Enforcement and termination
We may investigate suspected violations and warn, restrict, suspend, reset, or terminate access when reasonably necessary to protect the Service, users, platforms, or our rights. You may stop using the Service at any time and may request account-data deletion as described in our Privacy Policy. Sections that by their nature should survive termination will remain in effect.
8. Third-party services
The Service may rely on or link to third-party services, including Discord, Unity, Epic Games, Steam, Google, Apple, advertising providers, and storefronts. Their services are governed by their own terms and policies. We are not responsible for third-party services outside our control.
9. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
10. Limitation of liability
To the maximum extent permitted by law, Delta Tech Studios and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the Service. Our total liability for claims relating to the Service will not exceed the greater of the amount you paid us for the Service during the six months before the claim or 50 US dollars. This limitation does not apply where liability cannot lawfully be limited.
11. Governing law and disputes
These Terms are governed by the laws of the State of New York and applicable United States federal law, without regard to conflict-of-law principles. Courts located in New York will have jurisdiction over disputes, except where consumer law in your location requires otherwise. Before filing a claim, you and we agree to make a good-faith effort to resolve it by email.
12. Changes and contact
We may update these Terms to reflect changes to the Service, law, or our operations. We will post the updated Terms and revise the date above. Continued use after the effective date means you accept the updated Terms.
