These Terms of Service (“Terms”) are an agreement between you and Delta Tech Studios, operated by Trevor Mooney in New York, United States (“Delta Tech Studios,” “we,” “us,” or “our”). They govern your access to Tap N Jump, its Discord Activity, player-account features, websites, and related services (together, the “Service”). By accessing the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and parental involvement
You must be legally able to agree to these Terms. To use Tap N Jump through Discord, you must be at least 13 years old and meet Discord's minimum age requirement for your country. If you are below the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf. Tap N Jump is family-friendly and does not permit age-restricted content in its Discord Activity.
2. Discord and other platform terms
These Terms are between you and Delta Tech Studios, not Discord. Discord does not own, operate, or accept responsibility for Tap N Jump. Discord's own products and platform remain governed by Discord's Terms of Service and Privacy Policy. You must also follow the rules of every other platform through which you access the Service. If these Terms conflict with a platform's mandatory rules for your use of that platform, the platform's rules control to the extent of that conflict.
3. Limited license and ownership
Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to access and use the Service for lawful, non-commercial entertainment. The Service, including its code, art, audio, designs, characters, names, and other content, is owned by us or our licensors and is protected by intellectual-property law. No ownership rights are transferred to you.
4. Player accounts, connections, and permissions
You are responsible for activity under your player account and the security of connected platform accounts. Provide accurate information, protect your credentials, and notify us if you suspect unauthorized access. Never send us a password, payment-card number, or private access token. Linking or unlinking an identity may affect progress, inventory, entitlements, multiplayer access, or account recovery.
Tap N Jump requests only the Discord permissions reasonably needed for the feature you choose. Actions performed through Discord must be initiated or clearly authorized by you. You may revoke authorization through Discord's Authorized Apps settings, stop using the Activity, or request deletion as described in our Privacy Policy.
5. Acceptable use
You may not:
- Cheat, automate play, exploit bugs, manipulate scores, or interfere with matchmaking, lobbies, leaderboards, or other players.
- Reverse engineer, bypass security or privacy controls, probe infrastructure, distribute malware, overload the Service, or access non-public systems except where applicable law expressly permits it.
- Scrape, mine, harvest, re-identify, profile, sell, or commercially exploit Discord data, Service data, or another user's information.
- Use the Service or its permissions for surveillance, discriminatory decisions, unsolicited messages, spam, advertising, or off-platform contact without the recipient's permission.
- Impersonate another person or service, obtain credentials deceptively, misrepresent an affiliation with Discord, or misuse Discord's or our names, logos, or intellectual property.
- Harass, threaten, defraud, or share unlawful, infringing, sexually explicit, or otherwise age-restricted material through the Service.
- Sell, transfer, rent, or commercially exploit an account, virtual item, entitlement, or access to the Service without our written permission.
- Use the Service in a way that violates law, these Terms, or an applicable platform's rules.
6. Virtual items, currency, and purchases
The Service may include virtual currency, cosmetics, or other digital items. These are licensed access rights, not cash, property, or a bank account. They have no monetary value outside the Service, cannot be redeemed for cash, and may be changed or discontinued as the Service evolves. Purchases are processed by the applicable storefront or platform and are subject to its payment, cancellation, and refund rules. Except where law or a platform requires otherwise, completed digital-item purchases are final.
7. Testing features and service changes
Testing, preview, or beta features may be incomplete, unstable, or changed without notice. We may update, balance, suspend, restrict, or discontinue any part of the Service. We do not promise that progress, scores, availability, or features will remain unchanged forever, though we aim to communicate material changes reasonably.
8. Privacy and Discord API data
Our Privacy Policy explains what information we collect, how we use and share it, our Discord-specific data commitments, retention, security, and how to request access, correction, or deletion. By using the Service, you acknowledge those practices. The Privacy Policy does not reduce any rights provided by applicable law.
9. Enforcement and termination
We may investigate suspected violations and warn, restrict, suspend, reset, or terminate access when reasonably necessary to protect the Service, users, connected platforms, or our rights. You may stop using the Service at any time. Sections that by their nature should survive termination, including ownership, disclaimers, liability limits, and dispute terms, remain effective.
10. Third-party services
The Service may rely on or link to third-party services, including Discord, Unity, Epic Games, Steam, Google, Apple, storefronts, and infrastructure providers. Their services are governed by their own terms and policies. We are not responsible for third-party services outside our control.
11. Feedback
If you voluntarily send ideas or feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use and adapt that feedback for the Service without compensation or an obligation to implement it. This does not transfer ownership of your pre-existing intellectual property.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
13. Limitation of liability
To the maximum extent permitted by law, Delta Tech Studios and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the Service. Our total liability for claims relating to the Service will not exceed the greater of the amount you paid us for the Service during the six months before the claim or 50 US dollars. This limit does not apply where liability cannot lawfully be limited.
14. Governing law and disputes
These Terms are governed by the laws of the State of New York and applicable United States federal law, without regard to conflict-of-law principles. Courts located in New York will have jurisdiction over disputes, except where consumer law in your location requires otherwise. Before filing a claim, you and we agree to make a good-faith effort to resolve it by email.
15. General terms
These Terms and the documents they incorporate are the entire agreement about the Service. If a provision is unenforceable, the remaining provisions stay effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or sale of the Service. No third party receives rights under these Terms merely because it provides a connected platform or service.
16. Changes and contact
We may update these Terms to reflect changes to the Service, law, platform requirements, or our operations. We will post the revised Terms and update the date above. Material changes will receive additional notice when required. Continued use after the effective date means you accept the revised Terms.
